1. Acceptance of Terms

By accessing or using DeLeak.ai ("the Service"), operated by DeLeak.ai ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and DeLeak.ai.

2. Description of Service

DeLeak.ai provides automated content protection services for subscription content creators, including but not limited to: automated platform scanning and monitoring, DMCA takedown notice generation and submission, steganographic watermarking, facial recognition matching, deepfake detection, subscriber leak identification, and related analytics and reporting tools.

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years of age to use this Service. By creating an account, you represent and warrant that you are at least 18 years old.

4. Subscription and Payment

The Service is offered on a subscription basis. By subscribing, you agree to pay the applicable fees for your selected plan.

  • Fees are billed in advance on a monthly or annual basis depending on your selected billing cycle
  • All fees are non-refundable except as expressly stated in our refund policy (14-day money-back guarantee for new subscriptions)
  • We reserve the right to change pricing with 30 days advance notice
  • Failure to pay may result in suspension or termination of your account
  • Per-handle pricing means you are billed based on the number of creator handles you register for monitoring

5. Acceptable Use

You agree not to use the Service to:

  • Submit fraudulent or bad-faith DMCA takedown requests
  • Claim ownership of content that is not yours
  • Harass, abuse, or threaten any individual or entity
  • Violate any applicable law, regulation, or third-party right
  • Attempt to gain unauthorized access to the Service or its systems
  • Use the Service for any purpose other than protecting content you own or are authorized to protect
  • Reverse engineer, decompile, or disassemble any aspect of the Service

6. DMCA and Takedown Services

Our Service generates and submits DMCA takedown notices on your behalf. By using this feature, you represent and warrant that:

  • You are the owner or authorized agent of the content in question
  • The information provided in takedown notices is accurate
  • You understand that submitting false DMCA claims may result in legal liability under 17 U.S.C. Section 512(f)

DeLeak.ai acts as your authorized agent for DMCA submissions. We are not a law firm and do not provide legal advice.

7. Intellectual Property

The Service, including all software, algorithms, designs, text, graphics, and other content provided by DeLeak.ai, is protected by copyright, trademark, and other intellectual property laws. You retain ownership of your content. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DELEAK.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. WE DO NOT GUARANTEE THAT ALL LEAKED CONTENT WILL BE DETECTED OR THAT ALL TAKEDOWN REQUESTS WILL BE SUCCESSFUL.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Termination

You may terminate your account at any time through the account settings page. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the State of Delaware.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
